This statement is to let you know that we are taking advice from specialist intellectual property solicitors at a City law firm and our solicitors will be writing to all parties to deal with the matters raised in the letter.

We believe that the facts speak for themselves. Wojtek Kolan, our Business Development Director came up with the brand name T-Qualizer™ in February 2006. Thumbs Up has continued to use the brand name T-Qualizer™ since that date and have sold hundreds of thousands of products under that brand. You will no doubt have seen our stands at the Spring and Autumn Fairs and our extensive promotional and marketing since 2006, all of which use the T-Qualizer™ brand prominently. Our use of the brand pre-dates the trade mark registrations referred to in the letter and we believe that the T-Qualizer™ brand belongs to us.
